Introduction
Clutch Fire (“clutchfire.site,” “we,” “us,” or “our”) respects the intellectual property rights of others and expects its users to do the same. This Digital Millennium Copyright Act (DMCA) Policy outlines the procedures for addressing claims of copyright infringement on our website, clutchfire.site, which features content including news, tools, tech blogs, digital services, lifestyle articles, top stories, sports coverage, opinion pieces, health information, world news, and business analysis.
We will respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act (“DMCA”) and other applicable intellectual property laws.
Copyright Infringement Notification
Suppose you are a copyright owner or an agent thereof and believe that any content hosted on Clutch Fire infringes upon your copyrights. In that case, you may submit a notification under the DMCA by providing our designated copyright agent (see “Contact Information” below) with the following information in writing (see 17 U.S.C § 512(c)(3) for further detail):
Filing a DMCA Takedown Notice
To file a notice of infringing material on Clutch Fire, please provide a notification containing the following details:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- Identification of the copyrighted work claimed to have been infringed, or, if a single notification covers multiple copyrighted works at a single online site, a representative list of such works at that site.
- Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit Clutch Fire to locate the material. Providing URLs in the body of an email is the best way to help us locate content quickly.
- Information reasonably sufficient to permit Clutch Fire to contact the complaining party, such as an address, telephone number, and, if available, an electronic mail address at which the complaining party may be contacted.
- A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
- A statement that the information in the notification is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Please note that you may be liable for damages (including costs and attorneys’ fees) if you materially misrepresent that a product or activity is infringing your copyrights.
Upon receipt of a valid DMCA Takedown Notice, Clutch Fire will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged material from the website. We will also notify the user who posted the allegedly infringing material, if identifiable, and provide them with an opportunity to submit a counter-notice.
Counter-Notice Procedure
Suppose you believe that material you posted on Clutch Fire was removed or access to it was disabled by mistake or misidentification. In that case, you may file a counter-notification with us (a “Counter-Notice”) by submitting the following information in writing to our Designated Copyright Agent (see “Contact Information” below):
- Your physical or electronic signature.
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or access was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.
- Your name, address, telephone number, and email address, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or if you are outside the United States, for any judicial district in which Clutch Fire may be found), and that you will accept service of process from the person who provided the original DMCA notification or an agent of such person.
If our Designated Copyright Agent receives a Counter-Notice, Clutch Fire may send a copy of the Counter-Notice to the original complaining party informing that person that we may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the content provider, member, or user, the removed material may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the Counter-Notice, at Clutch Fire’s sole discretion.
Repeat Infringers Policy
Following the DMCA and other applicable law, Clutch Fire has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, users who are deemed to be repeat infringers. Clutch Fire may, at its sole discretion, limit access to the website and/or terminate the accounts of any users who infringe on the intellectual property rights of others, whether or not there is a repeat infringement.
Limitation of Liability
Clutch Fire is not liable for any content posted by its users or third parties that may infringe on another’s copyright. We act as a service provider and take claims of copyright infringement seriously. Our actions upon receiving a valid DMCA notice are intended to comply with our obligations under the DMCA.
